General Terms and Conditions
1 – TUSCANY UNCORKED SOCIETY
Porta di Bacco srl and Bottega del Nobile srl had launched the Tuscany Uncorked Society (hereinafter referred to as the “Wine Club Experience”), an initiative aimed at an exclusive and select circle of people. The goals of the Wine Club include carrying out and facilitating the study and dissemination of the culture of enjoying good wine, by promoting and spreading, among other things, knowledge of the history, key places, methods and production and conservation techniques of wine and other alcoholic drinks, while simultaneously encouraging aware and responsible drinking. Tuscany Uncorked Society also aims to develop and promote the Tuscany region and the beauties that our nation has given us.
Within the scope of these purposes, the Wine Club organizes and proposes participation in events, tasting sessions, masterclasses, seminars, lessons, excursions and trips; it produces and disseminates text and audio-visual content through every means of communication and every medium; it has a presence on the Web with its own sites, on portals and social networks, and carries out all other additional activities useful for achieving its ends.
The Wine Club operates in Italy and abroad, both directly and through links, twinning schemes and partnerships with other Clubs with similar or related objectives
2 – RESTAURANT
Our Wine Member has the opportunity to enjoy our three different restaurants located in Montepulciano historical center.
- Osteria Porta di Bacco: a lunch or dinner in full respect of the Tuscan culinary tradition with the guarantee of fresh products prepared daily. You will find tables arranged between the vaults of the ancient walls, distributed in several rooms, here you can see details of the oldest time, part of our past and our culture, the House where food is a gesture of love and hospitality and the guest is sacred.
- La Bottega del Nobile: our fine dining restaurant, the menu offers you high quality local products that our Chefs, carefully select, these will be served exclusively according to seasonality. You can taste many varieties of meat, all coming from local farms, as well as cheeses and whenever possible vegetables, from our garden cultivated in our Organic Farm.
- Antica Trattoria Il Marzocco: since 1860 where the Tuscan cuisine is presented as well as tradition with the ancient dishes that were cooked and still cooked in the Montepulciano families and in the Poderi. Ingredients of our land, oil, good wine and vegetables of our Bio Farm fresh harvested every morning
3 – CAFFETTERIA PALAZZO AVIGNONESI
In the Caffetteria, on the ground floor of Palazzo Avignonesi (known historical building of Montepulciano) in an environment of great prestige, we offer our guests the products of the Pasticceria Regina, which has been awarded and cited several times nationwide for excellent quality of its products. In the rooms of the Caffetteria, where you can comfortably relax while having breakfast, an aperitif or a prestigious wine label, you can admire the frescoes of the ‘500 that decorated what in 1550 were offices of Pope Marcello II Cervini, a unique and rare place
4 – PARCO VILLA TRECCI
Get in touch with yourself and nature. The park measures three hectares, you discover along a path that reveals to visitors different environments: the garden of gray plants, the grove, the rose garden, the large flowerbed of the grasses, the lake of the water with the swamp, the lemon-house, the open green spaces interrupted by olive trees and bushes with fragrant blooms. In this garden are collected almost four hundred different species of plants that do not require summer watering. You’ll be surprised how, in a place where it practically never rains, there is a lot of water all collected from the sky through drains and underground pipes
5 – ACCOMODATIONS
Our group has four different opportunities to offer at our guest in order to respect all kind of request.
- Villa Benefizio: an exclusive Villa in Montepulciano Immersed in the hills between Montepulciano and Pienza. A refined environment, in a panoramic area about 3km from the center of Montepulciano.
The private Wellness Center, with sauna, Turkish bath, tropical showers and Jacuzzi, the panoramic swimming pool and the park that surround it, make this residence the most exclusive our territory can offer you;
- Palazzo Nobile di San Donato: Entering this Palace is a magic, moving away from the door, you will feel like transported to a distant era, immersed in the charm of the early nineteenth century, among its original furnishings, and that refined luxury that perhaps we no longer have memory. The love for this historical period so luxurious and rich in beauty led us to renovate the Palace in Montepulciano following what are the original architectural structures and to use only furnishings that refer to that time in a unique atmosphere.
- Palazzo Mosela alla Porta:The property, located at the entrance of Montepulciano just after the ancient Porta al Prato, consists of 3 floors and 6 rooms. On the first floor there are two double bedrooms with all services, air conditioning and internet. On the second two rooms with even wider views. Complete the structure two rooms on the third floor each with independent bathroom and a unique view that is lost in the cultivated countryside and towards the upper part of the city where the bell towers and the municipal tower stand out.
6 – MEMBERSHIP REQUESTS
- Only natural persons may apply for Membership of the Wine Club, including when introduced by other Members or invited by the Wine Club itself.
- No membership fee required. To join the Club, Members must place a wine order for a minimum of €990 or 1.490 or 1.990 including VAT. A wine selection of same value will ship directly at your address twice time per year (12 bottles per shipping, value each shipping 750 euro);
- Members will receive two allocations of wine for each year of membership within. Our Wine expert will select your wine in basis of your preference and we will take care of the shipping.
- Following the first allocation, Members will have the right to place additional wine orders with no restrictions, including all available labels and vintages;
- Applications to join the Wine Club are subject to the sole discretion of the Company and Member status is personal and non-transferable;
- Within the first three months of the year, the Member’s credit card on file will be charged automatically, and prior notice for the total amount of €990 or 1.490 or 1.990 will be given. Wines will be shipped to the preferred address on file in March and November;
- Use of the services for the minimum annual amount indicated in point b) above is a necessary condition for keeping your Membership and ensuring its automatic and free renewal.
7 – MANAGEMENT OF TUSCANY UNCORKED SOCIETY WINE CLUB
The Wine Club is managed by the Company, which decides on the following matters:
- any amendment to the Wine Club’s contractual documents, including the General Conditions and terms of Membership;
- invitations, approval of Membership applications, exclusion from and forfeiture of the Wine Club;
- the creation and indication of Membership categories and the associated usage rights;
- determination of the amount owed to the Wine Club as a fee for each Membership category, as well as that necessary for keeping one’s Membership;
- the definition of the overall number of Members admitted to the Club, reserving the right, once the maximum number of Members has been reached, to change this number to reflect the spirit and exclusiveness of the Wine Club;

- The opportunity to have one of our chefs for a private event abroad or in Montepulciano.
The company shall issue and send a payment receipt to the account associated with the Member in question. Payment for all the Member’s expenses must be made by Credit Card, PaybyLink or Bank transfer.
Members shall have no right to participate in the decisions and activities of the Company, nor will they be held liable for any charge, cost or contingent liability of a civil and/or tax nature pertaining to the Company.
Membership of the Porta di Bacco Wine Club may not be sold, nor transferred on death.
Membership of the Wine Club does not include any entitlement to any profit or dividend of the Company. By signing this document, Members declare that they accept all conditions written in the above and below.
Wine Club Members are entitled to exercise their right to withdraw from the Wine Club Membership at any time, by notifying the Company in writing to the following email address: info@tuscanyuncorkedsociety.it
In the event of conduct which proves harmful or offensive to decency and/or mutual respect, the Company may, at its own discretion, decide to exclude a Member from the Wine Club.
Once the Company has informed a member of his/her exclusion or forfeiture, s/he may no longer participate in the activities of the Wine Club.
11 – APPLICABLE LAW AND JURISDICTION
- The relationship arising from Membership of the Wine Club is governed by Italian Law and the parties hereby agree that any dispute relating to, connected with and/or associated with that relationship must be subject to the exclusive jurisdiction of the Court of Siena;
- The contract is drawn up in Italian and translated, exclusively for the convenience of the customer, into English. The customer accepts that in the event of a discrepancy between the Italian version and the English version of these general conditions, the Italian version shall prevail.

The Wine Club staff will check any requests submitted and supply all the suitable information (provided that the Club possesses such information or may acquire it without unreasonable effort or expense).
13 – SIGNATURES
Pursuant to and in accordance with articles 1341 and 1342 of the Italian Civil Code, I, the undersigned, hereby declare that, after carefully reading this document, I approve the paragraphs of the general conditions of the Porta di Bacco Wine Club concerning Management of the Wine Club; Membership Request; Membership Benefits; Rights, Powers, Charges and Limitation of Liability; Withdrawal, Exclusion and Renewal; Applicable Law and Jurisdiction.
14 – PRIVACY
For the protection of privacy, the Customer acknowledges and accepts that, since the agreement with Porta di Bacco Srl is governed by Italian law, it is applicable the legislation contained in:
- the Legislative Decree is applicable 196/2003 (hereinafter “Privacy Code);
- Regulation EU n 679/2016 (hereinafter “GDPR”);
- Legislative Decree 101/2018
